Drilling for and hand-digging of wells/shafts

If the activity is carried out as a craft, it is necessary to obtain a crafts licence and register in the Crafts Register at the Chamber of Craft and Small Business of Slovenia (OZS).

Contractors wishing to carry out construction activities must meet the following requirements:

  • take out liability insurance for damages referring to the performance of their activities
  • conclude a full-time employment contract or a part-time employment contract in special cases in accordance with the act governing employment relationships with at least one employee who meets the requirements for aworks manager:
    • Certified Engineer (PI)
    • Works manager at the Slovenian Chamber of Engineers (IZS) - complex structures (Vz)
    • Works manager at the Slovenian Chamber of Engineers (IZS) - less complex structures (Vm)
    • Works manager at the Slovenian Chamber of Engineers (IZS) - non-complex structures or particular works (Vnp)
    • Works manager at the Chamber of Craft and Small Business of Slovenia (OZS) - master craftsman (Vozs)
    • Works manager at the Chamber of Commerce and Industry of Slovenia (GZS) - foreman (Vgzs)
  • In relation to the complexity of the structure and the type of construction it is necessary to appoint a supervisor.  

Contractors must appoint a relevant works manager for the construction and execution of works, according to the complexity of the structure:

Conditions

  • The right to pursue a craft activity for which suitable vocational qualifications are necessary, is obtained based on the craft business permit and entrance in the Craft Register at the Chamber of Craft and Small Business of Slovenia.

    Craft business permit is proof of fulfillment of the conditions for performing an activity.

  • Liability insurance for damages must include liability for damages that could be incurred by the investor or a third party in connection with the carrying out of their activities and must cover damage resulting from negligence, error or omission of the duties of the contractor and their employees, with the amount of the annual insurance premium not less than 50.000 EUR.

    If the contractor has taken out liability insurance for damages abroad, the insurance must cover the damage incurred in the Republic of Slovenia.

    Evidence

    • An insurance contract entered into in the Republic of Slovenia or in a Contracting State, provided that this insurance contract covers damage caused in the Republic of Slovenia.

    Legal basis

  • A works manager at the Slovenian Chamber of Engineers (IZS) is a person who meets the prescribed requirements and is entered in the register of works managers at the Slovenian Chamber of Engineers (IZS).

    Persons shall be entered in the register who have successfully passed professional examination for a works manager after having acquired adequate formal qualifications and gained at least three years of work experience, who took out the adequate liability insurance for damages, and who are not prohibited from practising the profession.

    The works manager is responsible to the contractor of construction works for the completed works’ compliance with the design documents, the regulations specifying in detail the essential and other requirements, as well as the regulations governing safety and health at the construction site.

    Responsible works managers are certified in individual professional fields as follows:

    • construction;
    • mechanical engineering;
    • electrical engineering;
    • technology, forestry and safety at work;
    • geotechnology and mining;
    • fire protection.

    Depending on the type of the structure or the works, a different level of education is required for works managers.   Accordingly, the Slovenian Chamber of Engineers (IZS) classifies the profession of a works manager into:

    • Vz – Works Manager – first-cycle study programmes
    • Vm – Works Manager – higher technical education 
    • Vnp – Works Manager – secondary technical education

  • The works manager at the Chamber of Craft and Small Business of Slovenia (OZS) is a person who meets the prescribed requirements and is entered in the register of works managers at the Chamber of Craft and Small Business of Slovenia (OZS). 

    Persons shall be entered in the register:

    • those who meet the requirements for a master craftsman in construction activities, or
    • craftsmen in construction who hold a crafts licence.

    The works manager is responsible to the contractor of construction works for the completed works’ compliance with the design documents, the regulations specifying in detail the essential and other requirements, as well as the regulations governing safety and health at the construction site.

    The tasks of the works manager at the Chamber of Craft and Small Business of Slovenia (OZS) are as follows:

    • management of particular works of COMPLEX and LESS COMPLEX structures;
    • management of construction of UNCOMPLEX structures.

  • The works manager at the Chamber of Commerce and Industry of Slovenia (GZS) is a person who meets the prescribed requirements and is entered in the register of works managers at the Chamber of Commerce and Industry of Slovenia (GZS). 

    Persons shall be entered in the register who:

    • meet the requirements for construction site foreman

    The works manager is responsible to the contractor of construction works for the completed works’ compliance with the design documents, the regulations specifying in detail the essential and other requirements, as well as the regulations governing safety and health at the construction site.

    Works managers at the Chamber of Commerce and Industry of Slovenia (GZS) shall carry out:

    • management of particular works of COMPLEX and LESS COMPLEX structures
    • management of construction of UNCOMPLEX structures.

  • Only a person entered in the register of certified engineers at the Slovenian Chamber of Engineers (IZS) may use the professional title of certified engineer in any form of official communication.

    Professional tasks of a certified engineer include:

    • construction and technical design of structures,
    • participation in the elaboration of spatial planning documents in so far as they relate to their professional field, and
    • carrying out construction, crafts and installation works, whereby:
      • the professional tasks of a certified engineer in construction refer to:
        • the professional field of construction, in particular
        • elaboration of plans for building, geotechnical, transport and similar structures of buildings and other construction works and for other spatial planning operations, and their execution,
        • the elaboration of construction plans for civil engineering works,
        • the elaboration of static and seismic analyses, seismic hazard studies and geological geomechanical analyses of the underlying soil, and the testing of building materials;
      • Professional tasks of a certified engineer in electrical engineering refer to: 
        • the professional field of electrical engineering, in particular to 
        • to systems, plants, equipment, machines and installations of production, transmission, distribution, transformation and accumulation of electricity, the use of electricity, protection against lightning and other overvoltage, protection against the negative effects of electricity, lighting, management, regulation, automation, measurement, control, signalling and supervision, protection against explosion and fire, technical security, media technologies, telecommunications and information technologies;
      • professional tasks of a certified engineer in mechanical engineering refer to:
        • the professional field of mechanical engineering, in particular to energy sector and installations in buildings and civil engineering works, technological equipment and plants, hydro-, thermo- and nuclear-energy plants, and transmission and distribution pipelines;
      • professional tasks of a certified engineer in the field of technology refer to:
        • the professional field of technology, in particular to chemistry and chemical technology, food, pharmaceutical, wood and textile technologies, metallurgy, sanitary engineering, zootechnics, biotechnology, technical product technology, and to forestry, and safety and health at work;
      • professional tasks of a certified fire engineer refer to:
        • the planning of fire safety measures
      • professional tasks of a certified engineer in geotechnology and mining refer to:
        • the professional field of geotechnology and mining, in particular to geotechnical structures, geotechnology, excavations and substructures for underground installations.

    Professional tasks of a certified land surveying engineer refer to the carrying out of land surveying activities, which include:

    • carrying out land surveying tasks in accordance with the regulations governing the recording of real estate, land surveying measurements and the tasks in accordance with the regulations on the national land surveying reference system,
    • land surveying measurements related to designing, construction and use of structures,
    • stakeout of structures,
    • the elaboration of land surveying plans, control observations and elaboration of deformation analyses,
    • data transformation between different national coordinate systems, and
    • mapping, processing, analysis and interpretation of spatial data.

    Professional tasks of a certified engineer in transport engineering refer to transport, in particular to:

    • sizing horizontal elements of traffic areas,
    • designing and elaboration of technology plans in transport,
    • producing traffic studies and traffic models and mobility plans,
    • planning of traffic signalling, transport networks based on traffic models and forecasts, roadblocks, public passenger transport networks and conceptual designs of transfer points (stops), and the designing of pedestrian areas and quiet traffic,
    • planning and implementing measures to increase traffic safety,
    • planning transport infrastructure,
    • planning, development and implementation of transport technologies and intelligent transportation systems.

    Professional tasks of a certified engineer also include:

    • managing projects,
    • supervising the construction of all types of structures,
    • works management,
    • elaboration of expert opinions, documents and studies in the professional field for which they are certified,
    • consulting services to the contracting authority and the representation of the contracting authority,
    • investment management.

    Certified engineers are persons who meet the prescribed requirements and are entered in the register of certified engineers at the Slovenian Chamber of Engineers (IZS) and undergoes continuing vocational training. By entering the register, they become members of the professional chamber.

    In providing services, the certified engineer is identified by a standard stamp bearing an identification number.

Cross-border/temporary provisions of activity

Foreign contractors established in a Contracting State wishing to perform construction activities in the Republic of Slovenia may perform these activities in all legal forms, provided that:

  • they meet the requirements for lawful performance of these activities in the country of establishment
  • have taken out liability insurance for damages  
  • have secured the participation (employment not necessary) of a works manager according to the structure

Before starting temporary carrying out of an activity as a craft the provider shall file an application for registration with the Chamber of Craft and Small Business of Slovenia.
