Organisation of package travel

The activity of organising package travel consists of organising package travels and selling them or offering them for sale. The activity may be performed by legal entities and individual sole traders – tour operators.

Package travel consists of at least two different types of travel services for the purpose of the same trip or holiday, if the services are combined by the service provider before a single contract on all services is concluded, including if the services are combined at the request of or in accordance with the selection of the traveller; or if irrespective of whether separate contracts are concluded with individual travel service providers, the services are:

  • purchased from a single point of sale and selected before the traveller agrees to pay;
  • offered, sold or charged at an inclusive or total price;
  • advertised or sold under the term "package travel" or under a similar term;
  • combined after the conclusion of a contract by which a company entitles the traveller to choose among a selection of different types of travel services, or
  • purchased from separate companies through linked online booking processes where the traveller's name, e-mail address and payment details are transmitted from the company with which the first contract is concluded to another company or companies and a contract with the latter company or companies is concluded at the latest 24 hours after the confirmation of the booking of the first travel service.

Linked travel arrangement means at least two different types of travel services purchased for the purpose of the same trip or holiday, not constituting package travel, resulting in the conclusion of separate contracts with the individual travel service providers, if a company facilitates: 

  • on the occasion of a single visit or contact with its point of sale, the separate selection and separate payment of each travel service by travellers; or
  • in a targeted manner, the procurement of at least one additional travel service from another company where a contract with such other company is concluded at the latest 24 hours after the confirmation of the booking of the first travel service.

The provisions concerning the conditions for carrying out the activity of organising package travel shall not apply to:

  • package travel and linked travel arrangements covering a period of less than 24 hours and not including overnight accommodation;
  • package travel and linked travel arrangements offered or performed occasionally (the total annual amount paid for their performance does not exceed EUR 15,000) on a non-profit basis to a limited groups of travellers only and not publicly advertised;
  • package travel and linked travel arrangements purchased on the basis of a general agreement for the arrangement of business travel between a company and another natural or legal person who is acting for purposes relating to the company's gainful activity.

The right to perform in the activity of organising package travel is acquired on the basis of a licence.

Tour operators must ensure that every organised group within an organised package travel and related domestic and international travel arrangement is accompanied by a tour leader and, if the package travel and related travel arrangement include guiding tourists, a tour guide can also carry out the tour leader's tasks. Tour operators are not obliged to provide a tour leader or tour guide during transport if the transport is organised by public transport, nor during the transport to and from the place of departure of the holiday or trip if the carrier provides an escort (conductor, steward, etc.)

Procedure for performing the activity – steps of the procedure

  1. The submission of application to the Tourism and Hospitality Chamber of Slovenia
  2. Verification of compliance with conditions
  3. Issue of a decision granting a licence
  4. Entry in the register after the decision has become final
  5. Assignment of a number to the beneficiary

Conditions

  • A licence for the activity of organising and selling packages is a condition for the lawful pursuit of this activity on the market.

    An application to obtain a licence must be lodged with the Tourism and Hospitality Chamber of Slovenia, where applications are considered by the Licensing Commission once a month.

    The Tourism and Hospitality Chamber of Slovenia issues a decision on granting a licence to the applicant.

    No licence is required if: 

    • package travel and linked travel arrangements cover a period of less than 24 hours and do not include overnight accommodation;
    • package travel and linked travel arrangements are offered or performed occasionally (the total annual amount paid for their performance does not exceed EUR 15,000) on a non-profit basis to a limited groups of travellers only and are not publicly advertised;
    • package travel and linked travel arrangements are purchased on the basis of a general agreement for the arrangement of business travel between a company and another natural or legal person who is acting for purposes relating to the company's gainful activity.

    The organiser of the package travel and linked travel arrangement referred to in indents one and two is obliged to inform travellers in a clear and comprehensible manner before the start of the package that it does not guarantee the fulfilment of the conditions for the pursuit of the activities of a tour operator. 

    The organiser of the package travel and linked travel arrangement referred to in indent one is obliged to provide a tour leader or a tour guide.

    Withdrawal of the licence:

    • The licensee ceases to perform the activity of organising packages and selling packages;
    • The licensee no longer meets the conditions laid down for a licensee.

  • A service provider is obliged to ensure that every organised group within the package travel and related domestic and international travel arrangement is accompanied by a tour leader and, if the package travel and related travel arrangement include guiding tourists and a tour guide who can also carry out the tour leader's tasks.

    Tour guides provide expert guiding of visitors in accordance with a programme provided in advance. 

    They are professionals who have passed the professional competence programme examination.

    Successful completion of the examination is evidenced by a tour guide licence card issued by the Tourism and Hospitality Chamber of Slovenia. The card must be visibly displayed when tour guide services are carried out.

    Tour guides that have passed the exam at the national level provide guiding services that are not limited to particular areas, while tour guides for a tourist area (municipal regulation) are only allowed to provide guiding services in their respective designated areas.

    Tour guides are required to submit data to the Tourism and Hospitality Chamber of Slovenia no later than by 31 January each year on the number of days they provided tour-guiding services and the countries in which they provided tour-guiding services in the previous year.

Cross-border/temporary provisions of activity

Performance of the activity in Slovenia is possible on cross-border/temporary basis. Acquisition of permits is not required prior to commencing the service.

Notwithstanding the conditions for obtaining a licence in the Republic of Slovenia, persons from a Contracting State who have acquired the right to perform the activity of organising and selling packages in the country in which they are established may occasionally perform the activity of organising or selling packages in the Republic of Slovenia.
