This SCA code includes activities and services for which entrance and/or other conditions for the commencement and pursuit of an activity are established. 

Regulations and conditions:

  • Consumer Credit Act

    Authorisation to perform consumer lending services

  • Prior to the implementation of consumer lending services, the lender must acquire an authorisation for the performance of such services. The authorisation is issued or extended by the ministry competent for the economy.

    The ministry issues or extends the authorisation if the applicant fulfils the personnel, education, spatial, organisational, technical and other conditions for performing consumer lending services. The conditions for acquiring the authorisation to perform consumer lending services are stipulated in the Rules on conditions for providing consumer lending services.

    The following institutions do not acquire the authorisation:

  1. banks and savings banks that acquire the authorisation to perform banking services under the act on banking;
  2. public housing funds;
  3. lenders who grant loans only to their own employees;
  4. non-profitable organisations which grant loans only for social and educational purposes on condition that this applies to loans to which this act does not apply. 
Credit Brokerage

    A credit broker must conclude a credit contract with a lender. The conditions for acquiring credit broker status are determined in the Rules on the conditions that a credit broker must fulfil. The following are not credit brokers:

  1. a natural person who is a mediator in the conclusion of credit contracts for the lender where the entity is employed;
  2. non-governmental consumer organisation entered in the register of consumer organisations that consults consumers on taking consumer loans within the scope of their consulting activity.

    Banking Act

    Banks may perform mutually recognised and additional financial services (including the performance of consumer crediting) on the territory of the Republic of Slovenia only on the basis of a licence from the Bank of Slovenia to provide these services, i.e. in accordance with Article 99 or Article 103 of the Banking Act.

This sub-class entails only financial brokerage that encompasses the granting of loans by non-monetary institutions. Credits take different forms, such as loans, mortgages, credit cards etc.

This entails:

  1. the granting of consumer loans;
  2. financing international trade;
  3. the provision of long-term loans to companies by branch banks;
  4. lending money outside the banking system;
  5. approving loans for the purchase of residential buildings by specialised non-depository institutions;
  6. pawn shops and pawnbrokers.
