Regulations and conditions:
Based on Article 4 of the Electronic Communications Act (ZEKom-1) any natural person or legal entity may provide electronic communications networks and/or electronic communications services subject to the conditions as set out in this Act and in the implementing regulations issued pursuant thereto, and in accordance with other legislation in force, provided this does not endanger public order, human life and health, public security or the defence of the state. Article 5 of ZEKom-1 determines in the first paragraph that notification must be given in writing to the Agency for Communication Networks and Services of the Republic of Slovenia (AKOS) prior to the commencement or alteration of the provision of public communications networks and/or public communication services. Article 5 of the ZEKom-1 stipulates in the fifth paragraph that after receiving the notification with all necessary information, the AKOS registers the operator in the official register. The entry in the official register does not constitute a condition for the implementation of the rights and obligations of operators under this Act. Confirmation does not constitute an administrative act and does not in itself provide rights and obligations under this Act. Since satellite communications in their nature reach beyond national borders, they are also subject to international and regional regulations in addition to national regulations. Furthermore, special attention must be paid to Decision No. 626/2008/EC of the European Parliament and of the Council of 30 June 2008 on the selection and authorisation of systems providing mobile satellite services (MSS). Activities/services as per the explanatory notes on the standard classification of activities: This sub-class entails activities of operation, maintenance or the provision of access to voice, sound, data, text and video transmission via satellite telecommunication infrastructure. The transmission of radio and television programmes via the satellite network directly to households is also included. The units classified here do not generally originate programming material.
