Traffic in explosives

The term traffic in explosives includes trade, use, handling, storage and preparation of explosives at the work site and destruction of explosives.

A legal entity or an entrepreneur can start trade in explosives after obtaining a permit from the Ministry of the Interior.

If the permit holder changes its activity, the premises where it performs its activity or its legal status, it must obtain a new permit.

Conditions

  • A legal entity or an entrepreneur can start trade in explosives after obtaining a permit from the Ministry of the Interior.

    If the permit holder changes its activity, the premises where it performs its activity or its legal status, it must obtain a new permit.

    The permit holder must notify the Ministry of the Interior in writing within eight days of any change in legal status, change of the responsible person or cessation of the performance of the activity.

    Permit may be revoked if the legal entity or entrepreneur:

    • no longer meets the conditions prescribed by law,
    • ceases to perform the activity.

    Within eight days after the decision on permit revocation becomes final, the legal entity or entrepreneur must hand over to the Ministry all the records that it is required to keep.

  • A permit for purchase and transfer of explosives or pyrotechnic products of category 3, which can be used only by professionally trained persons, as well as categories F4, T2 and P2, in the territory of the Republic of Slovenia is issued by the competent authority to a legal entity or entrepreneur who has been granted a permit for trade in explosives or pyrotechnic products.

    A permit for purchase and transfer can be issued for a single or for multiple purchases and transfers of explosives or pyrotechnic products with validity of up to twelve months from the date of issuance.

    If the permit holder does not use the permit, it must return it to the competent administrative unit within eight days after the expiry of validity.

    The transport provider must ensure that the driver has a permit for purchase and transfer for the entire duration of the transport of explosives or pyrotechnic products. The driver must show the permit at the request of a police officer.

    Revocation of permit

    A permit for purchase and transfer may be revoked by the competent administrative unit if this is required for public safety concerns.

  • A permit for transfer in the European Union and for import or export may be issued to a legal entity or an entrepreneur who has obtained a permit for the production or trade in explosives, pyrotechnic products or ammunition. In the case of the issuance of a permit for transfer of explosives, pyrotechnic products or ammunition, a permit for the production or trade in explosives, pyrotechnic products or ammunition is not required.

    A legal entity or an entrepreneur without a permit for the production or trade in explosives, pyrotechnic products or ammunition may only carry out transport of explosives, pyrotechnic products or ammunition.

    The transport provider must ensure that the driver carries with them the permit for transfer, import, export or transit for the entire duration of the transport. The driver must show the permit on request to a police officer or customs official.

    The holder of a permit for import, export or transit of explosives of subclasses 1.1 and 1.2 must notify the border crossing indicated in the permit 48 hours before the expected arrival.

    The issuance of a permit for transfer in the European Union and for import or export is tied to the prior possession of a permit for the production of or trade in explosives, pyrotechnic products or ammunition.

    Revocation of permit

    The Ministry of the Interior can specify in a permit special security measures for import, export or transit of explosives, pyrotechnic products or ammunition across the territory of the Republic of Slovenia or revoke a permit that has already been issued if this is required by public safety concerns.

  • Explosives or pyrotechnic products may be placed on the market when their compliance has been determined according to the prescribed procedure and they bear the CE mark.

    Before explosives or pyrotechnic products are placed on the market, they must be notified to the Ministry, which issues a notification certificate. An explosive or pyrotechnic product for which a notification certificate has been issued is included in the list of explosives or the list of pyrotechnic products, which are published on the Ministry's website.

    Explosives or pyrotechnic products are notified by a legal entity or an entrepreneur who has a license to manufacture or trade with explosives or pyrotechnic products.

    Revocation of notification of explosives or pyrotechnic products

    The Ministry of the Interior, on the proposal of the Inspectorate of the Republic of Slovenia for the Interior, revoked issued notification certificate by decision in whole or in part, when re-testing of explosives or pyrotechnic products reveals their non-compliance with the essential safety requirements, which cannot be remedied subsequently.

Cross-border/temporary provision of activity

Foreign legal entities may engage in cross-border/occasional trade in explosives if they meet all of the prescribed conditions and obtain prior permission from the Ministry of the Interior.
