Concession for building cableway installations

The concession for building cableway installation sets forth the rights and obligations of the concessionaire. This is an agreement according to which the payment for the public procurement is substituted by the right to use the built facility or this right is combined with the payment. The concession for the cableway installation is granted by the municipality or the city in which the installation is located. In the event that the cableway installation exceeds the significance of the ski slope on which it is located, the concession is granted by the state.

Various positions regarding concessions are possible:

  • The concession agreement does not foresee the transfer of ownership onto the concession provider after the concession expires. Furthermore, it does not foresee public services to be carried out on this installation.
  • The concession agreement foresees the transfer of ownership onto the concession provider after the concession expires. The agreement does not foresee public services to be carried out on this installation. The majority of the risk is assumed by the concessionaire;
  • The concession agreement foresees the transfer of ownership onto the concession provider after the concession expires. The agreement does not foresee public services to be carried out on this installation. The majority of the risk is assumed by the concession provider;
  • The concession agreement does not foresee the transfer of ownership onto the concession provider after the concession expires. At the same time, it is foreseen that a public service is to be performed on this installation;
  • The concession agreement foresees the transfer of ownership onto the concession provider after the concession expires. At the same time, it is foreseen that a public service is to be performed on this installation. The majority of the risk is assumed by the concessionaire;
  • The concession agreement foresees the transfer of ownership onto the concession provider after the concession expires. At the same time, it is foreseen that a public service is to be performed on this installation. The majority of the risk is assumed by the concession provider.

The procedure for the granting of the concession takes place in the following five phases:

  • preliminary procedure,
  • the adoption of the concession act,
  • invitation to tender,
  • decision on the selection,
  • and the granting of the concession.

The Government adopts a decree on the granting of the concession which foresees the location of the cableway installation and sets forth the terms and conditions. The investor submits an application and supporting documentation. On the basis of a complete application, the Government of the Republic of Slovenia grants a concession by means of a decision.

In the event that this is an installation that already has traffic connections with existing cableways or other recreational surfaces, the concession is granted without an open invitation to tender.
