Regulations and conditions:
Insurance agency and brokerage services may be performed only by an insurance agent or brokerage company which has obtained a permit to perform insurance agency activities or a brokerage permit. The permit is issued by the Insurance Supervision Agency – Article 227 of the Insurance Act. Insurance brokerage may also be carried out by banks that have acquired a licence from the Bank of Slovenia. The Bank of Slovenia issues a licence on the basis of a preliminary opinion of the Insurance Supervision Agency. Insurance agency services may also be provided by other entities if insurance is concluded that is directly related to the main service provided (e.g. forwarding agents and persons performing roadworthiness tests), and if they have acquired a licence to pursue the activity of insurance agencies. An insurance broker provides brokerage services in the conclusion of insurance contracts for one or more insurance companies. Insurance brokerage is a service that strives to make contact between policyholders and insurance companies in order for policyholders to negotiate with insurance companies on the conclusion of an insurance contract. In addition to the aforementioned, insurance brokerage also includes activities related to preparations for the conclusion of an insurance contract, and assistance with the exercise of the rights arising from the contract, especially with the settling of claims addressed to an insurance company. An insurance agent is a person who, on the basis of employment or other legal relationship with an insurance company or an insurance agency, is authorised to conclude insurance contracts in the name and for the account of the insurance company. Besides concluding contracts, insurance brokerage also entails activities connected with preparations for the conclusion of an insurance contract and assistance at the execution of rights under the contract, especially in settling indemnification claims addressed to the insurance company. Insurance agency or brokerage transactions may be implemented only by natural persons with a licence from the Insurance Supervision Agency to perform insurance agency or brokerage transactions at an insurance company, insurance agency company or insurance brokerage company or entity as per the fourth paragraph of Article 227 of this Act or bank as per the fifth paragraph of Article 227 of this Act. |
