Establishing conformity of articles of precious metals
To pursue this activity, an entry permit is required.
The establishment of conformity of articles of precious metals is carried out by a legal entity or a sole trader appointed by the Metrology Institute (hereinafter referred to as ‘competent authority’). The procedure of conformity establishment commences on the basis of a request to test and mark articles of precious metals with a compliance mark submitted to the authority by a supplier.
During the procedure of conformity establishment, the competent authority establishes:
- conformity of articles through quantitative chemical analyses,
- the compliance with the standard of fineness,
- and the compliance of markings.
During the pursuit of the activity, the competent authority must ensure the suitability of subcontractors, follow the instructions of the Institute and observe the national price list.

Applicants who wish to pursue this activity must register the business activity, and have the appropriate legal status.

The appointment procedure commences when a legal entity or a sole trader files a request for appointment at the Metrology Institute (hereinafter referred to as ‘Institute’).
The director of the Institute appoints a three-member expert committee for the assessment (hereinafter referred to as ‘committee’). The committee proposes to the director of the Institute an opinion on the fulfilment of the requests for appointment on the basis of the study of the submitted documentation and an assessment visit with the applicant.
Based on the committee's opinion, the director of the Institute determines a proposal for appointment and submits it to the competent minister who issues a decision on appointment.
The decision on appointment defines in more detail the obligations of the appointed legal entity or sole trader.
The applicant who shows their competence with an accreditation document is issued a decision until the termination of the accreditation document. The decision on appointment may be extended only if the applicant submits valid evidence.

The appointed person may award part of tasks which must be exactly defined to a subcontractor.
To show suitability, subcontractors must meet the prescribed requirements:
- valid accreditation document in accordance with the standard,
- technical and staffing capacity and location,
- last approved version of the technical documentation with a description of all activities for the establishment and confirmation of conformity of articles.
The appointed person must establish the competence of the subcontractor, keep a record about it and take full responsibility for the work carried out by the subcontractor.
The appointed person must keep a record of subcontractors and tasks allocated to them.

The appointed person must carry out the following tasks:
- test and mark articles of precious metals which must be carried out in the same manner as it is carried out by the Institute;
- follow, and adjust to, technical development in the field of testing and marking of articles of precious metals;
- participate in interlaboratory comparisons;
- prepare and submit to the Institute three-month reports and annual reports on the work carried out;
- allow the Institute to access all data and premises;
- keep all records of test results for at least five years;
- inform the Institute of all appointment-related changes.
