Regulations and conditions:
Mining rights are rights for research and exploitation of mineral materials for economic purposes, and it is classified to mining right for research and mining right for exploitation according to the manner and purpose of its pursuance. The mining right for research is obtained with permit for the research awarded to a legal entity or a natural person in a specific research area for a certain period of time. The mining right for exploitation is a right obtained on the basis of the mining concession act with a concession for the exploitation of certain types of mineral resources in a given exploitation area. Concession for exploitation for a certain exploitation area is granted on the basis of a previously issued mining concession act and on the basis of public tender for the selection of the holder of the mining rights for exploitation under this act. Concession for exploitation may also be granted without a public tender if the applicant fulfils the required conditions (Article 34 of the Mining Act (ZRud-1)). Prior to the conclusion of a concession agreement the holder of the mining rights must submit the following to the ministry responsible for mining: If the holder of mining rights does not fulfil the conditions for the provider of mining work, they must conclude a written contract for the provision of work prior to the beginning of the mining with the provider of mining, who does fulfil the required conditions. Prior to the provision of activities and throughout the business operations, the provider of mining, mining project engineer, geological project engineer and mining supervisor must have insured liability for damages that could emerge in connection with the performance of their activities. The provider of mining may be a natural person or a legal entity who provides services in the implementation of mining as an economic activity established in the Republic of Slovenia and who has guaranteed participation of at least one person, who meets the conditions to be a technical head of organisational work in mining. Technical head of organisational work in mining is a person who is accountable to the provider of mining for compliance of mining with mining technical documentation, technical regulations and regulations in the field of ensuring safety and health at work. Technical head of organisational work in mining may be an individual who has completed professional examination and is registered in the register of authorised persons in the field of mining kept by the ministry responsible for mining.
