Placing treated articles on the market

A treated article is a substance, mixture or product which has been treated with one or more biocidal products.

A treated article is not placed on the market unless all the active substances in the biocidal product which is used for the treatment of an article or which a treated article contains are included on the list of active substances.

A person responsible for placing a treated article on the market must ensure that the article is properly labelled.

Conditions

  • The following information must be provided on the label of a treated product:

    •  statement that the treated product contains biocidal products;
    • biocidal characteristics of the treated product;
    • names of all active substances which contain a biocidal product;
    • names of all nanomaterials;
    • all relevant instructions for use, including all precautions which must be adopted due to the biocidal products with which the product was treated or which the treated product contains;
    • all relevant instructions for use, including all necessary precautions for the protection of people, animals and the environment.

    The label must be clearly visible, legible and indelible. When this is necessary due to the size and function of the treated product, the label is printed on the packaging, the instructions for use or the warranty certificate in the official language of the member state of import. In the case of treated products which are not produced in series but on the basis of a special order, the producer may agree on other ways of ensuring sufficient information for consumers.

    At the request of a consumer, the supplier of the treated product must provide information on the biocidal treatment of a treated product within 45 days free of charge.
