Regular maintenance of facilities for navigation safety
Regular maintenance of facilities for the safety of navigation and navigation routes is implemented as a public utility service based on a concession contract, by a public company or public utility unit.
Currently, regular maintenance of facilities for navigation safety in Slovenia is implemented only on the basis of the granted concession contract.
The facilities for navigation safety are:
- lighthouses,
- coastal lights,
- buoys,
- other signs and devices for safe navigation at sea, navigation routes and in ports.
Regular maintenance of facilities for the safety of navigation is implemented on navigation routes in the territorial sea and internal waterways of the Republic of Slovenia with the purpose of guaranteeing undisturbed operations of facilities for navigation safety.
Regular maintenance of facilities for navigation safety is ensured:
- at Koper freight port,
- other ports intended for public transport, local ports, military ports, except in marinas and sport ports.
Local communities ensure regular maintenance of facilities for navigation safety in marinas and sport ports.

Applicants who wish to pursue this activity must register the business activity, and have the appropriate legal status.

The public utility service for regular navigation safety maintenance facility is performed on the basis of a concession agreement.
The competent authority selects the candidate based on the best application and issues a Decision on the concession. After the decision on the concession becomes final, a concession agreement is concluded. The tasks of the concession provider in the process of granting the concession and in relation to the concession is implemented by the Slovenian Maritime Administration, except for certain tasks and decisions that are under the jurisdiction of the Government of the Republic of Slovenia.
The concession agreement governs all mutual relations, risks and penalties.
The concession is granted for seven years.

Within 20 days of concluding the concession contract, the concessionaire must submit an unconditional, irrevocable and payable bank guarantee to the concession provider.
The bank guarantee must be valid for at least one year for the amount determined in the tender documentation.
The guarantee must be extended by the concessionaire by at least one year or until the deadline of the concession at least three months prior to its expiry.

Within 30 days of concluding the concession contract at the latest, the concessionaire must take out insurance against damage to a third party or the concession provider which could be arise as a result of implementing a public utility service.

The provider of the public utility service must keep separate accounting records on the costs of the regular maintenance of navigation safety objects and budget funds received for the implementation of the public utility service.

The concessionaire must annually report in written form to the Slovenian Maritime Administration on the fulfilment of obligations under the concession contract.
The report must contain data on the costs of maintaining navigation safety objects, services performed, data on the condition of navigation safety objects and other data that affect or could affect the concession relationship.
In addition to the report, the concessionaire must also submit annual financial statements to the Slovenian Maritime Administration.

Cross-border/temporary provisions of activity
Cross-border provision of regular maintenance of facilities for navigation safety shall be conducted in compliance with the conditions in accordance with the legislation of the Republic of Slovenia.
