Concession for electrical energy transmission
The Republic of Slovenia as the concession provider can provide a concession for the implementation of the public utility service of electrical energy transmission operator for the entire territory of the Republic of Slovenia for a maximum period of 50 years.
The Government of the Republic of Slovenia issues a decision granting the concession for the implementation of the public utility service under this regulation to the concessionaire without a public tender. Mutual relations between the government and the concessionaire are specifically regulated in the concession contract. The concession fee is not paid for by the concession.
The system operator activity can be implemented by a concessionaire who fulfils the following conditions:
- owns a transmission system;
- system operator certificate and
- has been appointed as a system operator.

Transfer system operators must own the entire transfer system to pursue the activity of electricity transmission. Transmission systems where transmission system operators pursue their activity must not be partially or fully owned by another party.

Transmission system operators must be certified.
The certification procedure commences when the owner or the operator of the transmission system files a complete application for the issue of the certificate.
When it receives a complete application for certification, the competent authority issues a certificate of receipt of a complete application which must include the deadline for the decision on the certification request and information on the conditions when the legal basis for the issue of the certificate is used.
The competent authority must decide in the matter within four months of the receipt of a complete application.

At the proposal of the Energy Agency, the Government appoints the operator of the transfer system with a decision.
A decision on the appointment is published in the Official Journal of the European Union and the Official Gazette of the Republic of Slovenia, and submitted to the European Union.
