Entry in the List of Notaries

Persons who meet the conditions to practice the profession of notary and are appointed by the minister responsible for justice are entered in the List of Notaries managed by the Chamber of Notaries of Slovenia.Prior to the appointment, the minister acquires the opinion of the Chamber of Notaries of Slovenia.

The Chamber of Notaries of Slovenia determines and publishes the date of the beginning of the notary's activities in the Official Gazette of the Republic of Slovenia.

Conditions

These terms apply to the profession Notary

  • The applicant must be a national of the Republic of Slovenia.

    Evidence

    The applicant submits a copy of a valid personal document, which proves Nationality or proof of the nationality issued according to the regulations of the home Member State.

  • The full legal competence is acquired by an adult natural person when he or she reaches the age of 18, by marrying married prior to coming of age, and, with a court decision, also by a minor who becomes a parent.

    Legal basis

  • The state legal examination may be taken by an individual who meets the following general conditions:

    1. is a national of an EU Member State and has active knowledge of the Slovenian language;
    2. is legally competent and in appropriate health;
    3. has acquired the following professional titles in the Republic of Slovenia  or has completed an equivalent education abroad which is recognised in accordance with the act  regulating the recognition and assessment of education:
    • professional titles of univerzitetni diplomirani pravnik (Bachelor of Laws),
    • diplomirani pravnik (Bachelor of Laws) and magister prava (Master of Laws),
    • and magister prava on the basis of the long non-structured masters' study programme.

    An applicant who has passed the professional examination to be appointed a title or professional examination for public administration is exempt in the state legal examination from being tested on constitutional organisation, organisation of justice and public administration, foundations of the legal arrangement of the European Union.

    An applicant who has passed the professional examination for administrative procedure is exempt in the state legal examination from being tested on administrative law, administrative procedure and administrative disputes.

    An applicant who has passed the professional examination on the basis of the Zakon o pripravništvu, strokovnih izpitih in izpopolnjevanju strokovne izobrazbe delavcev v državni upravi in pravosodju will be exempt in the state legal examination from being tested on:

    • administrative law, administrative procedure and administrative disputes,
    • constitutional organisation, organisation of justice and public administration, but will not be exempt from being tested on the foundations of the legal arrangement of the European Union.
  • Education:

    • The applicant must have acquired the professional title of univerzitetni diplomirani pravnik (Bachelor of Laws) or completed equivalent education abroad recognised in accordance with the act which regulates the recognition and assessment of education.

    Work experience:

    • The applicant must have at least five years of practical experience in lawyers’ activities after he or she passed the state legal exam, at least one year of which should be with a notary, at a court, with a lawyer, at the State Prosecutor's Office or State Attorney's Office.

    Evidence

    Evidence of education acquired in Slovenia:

    • diploma or certificate – original, certified or uncertified copy with a possibility of viewing the original.

    For education acquired in the EU:

    • diploma, certificate, other proofs of formal education acquired in the EU – original or certified copy, with attached certified translation into Slovenian;
    • evidence of the content and course of training, stating the duration of the study programme and syllabus of the study programme, demonstrating the number of hours or credit points for individual subjects – original or certified copy with attached certified translation into Slovenian.

    For years of service:

    • full-time employment contract – copy.

  • A trustworthy person is someone regarding whom it may be justifiably deduced, on the basis of current work, actions or behaviour, will practice notaries’ activities professionally and fairly; that as a notary, he or she will protect the reputation of the profession of notary, and be impartial in his or her actions.

    The applicant must not have been convicted of a criminal offence due to which he or she in not worthy of pursuing the profession until the criminal sanction has been struck from the record. Suitability is verified by a committee appointed by the minister responsible for justice.

    Members of the committee are required to have passed the state legal examination and have at least five years' experience in lawyers' activities. The committee submits its opinion to the minister responsible for justice within seven days of the selection procedure being completed.

  • If the applicant is not the citizen of the Republic of Slovenia, he must attach the evidence on the active knowledge of the Slovenian language to the application for the entry in the register the. The active knowledge of the Slovenian language is determined on the basis of the certificate issued  by the Centre for Slovene at the Faculty of Arts of the University of Ljubljana.

  • An applicant must be below the age of 64 to be appointed a notary.

  • The conditions for the suitability of equipment and premises are determined by the Chamber of Notaries of Slovenia.

    The suitability of equipment and premises is verified by a committee appointed by the minister responsible for justice. Members of the committee have passed the state legal examination and have at least five years' experience in lawyers' activities.

    The committee submits its opinion to the minister responsible for justice within seven days of the selection procedure being completed.

    Recommendation of the Chamber of Notaries:

    • suitable premises include a waiting room, room for certifications, conference room and room for the notary's archives;
    • suitable equipment includes state-of-the-art computer equipment, fireproof metal cabinet and steel cash register.
