Export licence

An export license is required for exports of scheduled substances that require a customs declaration, including exports of scheduled substances leaving the customs territory of the Union after being stored in a free zone of control type I or in a free warehouse for a period of at least 10 days.

An export license is not required if the scheduled substances are re-exported within 10 days from the date of their placing into a suspensive procedure or entered in a free zone of control type II.

Exports of Group 3 scheduled substances shall be subject to an export license only if they are subject to prior export notification or when those substances are exported to certain countries of destination to be determined in accordance with the committee procedure in order to ensure an appropriate level of control.

The export license shall be issued by the competent authorities of the Member State in which the operator is established. In Slovenia, the permit is issued by the  Chemicals Office of the Republic of Slovenia.

The export license shall be presented to the customs office when the customs declaration is lodged or, in the absence of a customs declaration, to the customs office of exit or to the other competent authorities at the place of exit from the customs territory of the Union. The authorization shall accompany the consignment to the third country of destination.

Any export of a scheduled substance to specific countries of destination shall be subject to a prior export notification sent by the competent authorities in the Union to the competent authorities of the country of destination. Before exporting such substances, the competent authorities of the Member State concerned shall provide the competent authorities of the country of destination with the information contained in the application for an export license.

Competent authorities may use simplified export authorization procedures where they are satisfied that there is no risk of diversion of scheduled substances.
