Permit for trade in explosives

A legal entity or an entrepreneur can start trade in explosives after obtaining a permit from the Ministry of the Interior.

If the permit holder changes its activity, the premises where it performs its activity or its legal status, it must obtain a new permit.

The permit holder must notify the Ministry of the Interior in writing within eight days of any change in legal status, change of the responsible person or cessation of the performance of the activity.

Permit may be revoked if the legal entity or entrepreneur:

  • no longer meets the conditions prescribed by law,
  • ceases to perform the activity.

Within eight days after the decision on permit revocation becomes final, the legal entity or entrepreneur must hand over to the Ministry all the records that it is required to keep.

  • In order to perform the activity, you are obliged to register and select the appropriate status form.

  • A person responsible for trade in explosives is an individual who has appropriate professional competence and is at least 18 years old.

    People who perform individual work with explosives or pyrotechnic products for a legal entity or entrepreneur must have professional competence and must have no public order concerns.

    People who use subclass 1.1 or 1.2 explosives must be medically fit.

    People who are responsible for the correct use of explosives must demonstrate at least basic knowledge of the Slovenian language.

  • A trader who wishes to obtain a permit for wholesale trade in explosives must have a suitable warehouse with a capacity of at least 16,000 kg of NEW (net explosive weight).

    Facilities for the production, sale and storage of explosives must be built and equipped in such a way that fire protection, protection of life and health of people and of property, and environmental protection are ensured. Production, sale and storage facilities must be secured against access by unauthorised persons.

    A storage facility intended for wholesale in explosives is a hazardous facility. A hazardous facility must be secured by a fence at least 2.20 m high. The fence around a hazardous facility must be placed at a distance of at least 10 m from the facility. Outside of work hours, the storage facility must be mechanically and electronically protected and additionally secured by a video surveillance system. In the case of electronic protection against burglary, the signal must be linked to the intervention centre of the company that performs the security service.

    Mechanical protection of the facility means that all windows are secured with metal gratings or metal blinds or have metal frames and safety glazing. Doors must be solid (wood, metal etc.) without glass openings, with a multi-point locking mechanism, and in case of single-point locking they must be additionally secured by a bar.

    Electronic protection of the facility is a security system with a security alarm control panel, various types of electronic detectors and sound and light alarms, as well as the capability for the transmission of the alarm signal to the intervention point.

    A video surveillance system is the visual observation and control of a room or area with a video camera and the lawful storage of recordings.

    Portable warehouses:

    Explosives can also be stored in standard portable warehouses, for which the manufacturer issues a declaration of conformity and installation instructions, and which can be installed as temporary or permanent facilities. Installation is permitted only with a permit for the production or trade in explosives.

    A maximum of 500 kg of NEM can be stored in an individual portable warehouse.  The distance of a portable warehouse from the facilities must be in accordance with the prescribed distance from the table of safe distances from Annex 2 of the Decree on special requirements for premises containing explosives or pyrotechnic products. A portable warehouse must be earthed and anchored to the ground, so that uncontrolled violent lifting is prevented. Dry grass and undergrowth must be removed in the area inside the fence and for five metres from the fence of the storage facility.

    A portable warehouse must be protected by a metal wire fence, mechanically secured and inspected at least once a day when there are explosives in the portable warehouse, and a record must be kept about the daily inspections. A fence is not required if the area where the warehouse is placed is guarded or if the warehouse is protected electronically or with video surveillance.

    A portable warehouse must not be placed on accessible, driveway or work surfaces for emergency vehicles. The owner must inform the Ministry of the Interior about the installation or relocation of a portable warehouse no later than eight days after the installation or relocation. The notification must list the type of property (rental, owned), the type of portable warehouse and a graphic representation of the location in the space.

  • A legal entity or entrepreneur who carries out wholesale trade in explosives must keep records that enable electronic data collection and storage and contain a unique identification number and traceability of the explosive.

    A legal entity or entrepreneur who carries out wholesale trade in explosives must allow the Ministry of the Interior, the Police and the Internal Affairs Inspectorate to access, inspect and search data in the records via a remote connection. The mentioned obligation also applies to legal entities or entrepreneurs who use explosives in their work and keep records in electronic form.

  • A legal entity or entrepreneur can prepare explosives at the work site if they have specialised equipment for this that is exclusively designed for the preparation of explosives at the work site, and a permit for the preparation of explosives at the work site.

  • A legal entity or entrepreneur who applies for a permit for trade in explosives must attach to the application a safety statement with a risk assessment, as determined by the regulations governing occupational safety.
