Preliminary environmental impact assessment (preliminary procedure)
The preliminary procedure is a preliminary assessment procedure to determine whether individual works will require an environmental impact assessment and environmental consent.
It is only carried out for activities affecting the environment, which due to the nature of the proposed works or their location may be expected to have significant effects on the environment as defined in the Decree.
An application for an environmental impact assessment (preliminary procedure) can be submitted:
- in electronic form via the SPOT portal or
- in physical form to the Ministry of the Environment, Climate and Energy.

Preliminary Environmental Impact Assessment (preliminary procedure)
The entity responsible for the intended works must enclose with the request for a preliminary procedure a description of the works, of the surroundings or their parts that will probably be affected, and of the potential substantial impacts of the intended works on the surroundings or their parts. The application may include a description of the measures envisaged to reduce or avoid significant adverse effects on the environment.
Upon receipt of a complete application, the ministry shall make the application for the preliminary procedure available to the public by publishing it together with a public notice on the central website of the state administration and shall ensure that members of the public with a specific interest have the right to participate by giving their opinions and comments within 30 days from the date of publication.
In this procedure, the non-governmental organisation referred to in paragraph one of Article 237 of the ZVO-2 and the civil society initiative referred to in the second indent of point 18.2 of Article 3 of the ZVO-2 shall have the status of an intervener if they have submitted a request to intervene in the procedure within 30 days of the date of publication, whereby the request to intervene must also include information on the secure electronic mailbox to which they will be served the documents by the ministry.
Upon receipt of a complete request, the Ministry of the Environment, Climate and Energy will issue a decision on whether the proposed works are subject to an environmental impact assessment and environmental consent. The decision will be published on the central website of the state administration and will also be sent to the competent inspection authority and the municipality in whose territory the proposed works will take place.

The application for a preliminary environmental impact assessment can be submitted in electronic form via the SPOT portal or in physical form at the Ministry of the Environment, Climate and Energy. The procedure requires the attachments listed below and the payment of the costs.
