Recognition of professional qualifications under the title of a lawyer

A lawyer from another EU Member State is entered in the register of foreign lawyers who may practice the profession of lawyer in the Republic of Slovenia under the professional title of lawyer, with all the rights and obligations pertaining to the practice of the profession of lawyer if the person meets the following conditions:

  • the person is trustworthy in respect of the practice of the profession of alawyer;
  • has the capacity to conclude contracts;
  • has an active knowledge of the Slovenian language;
  • has the appropriate equipment and premises required to practice the profession of lawyer;
  • has insurance for damage liability;
  • has passed an exam on knowledge of Slovenian legislation.

To be entered in the register, a lawyer must attach proof of nationality and proof that he or she has the right to practice the profession of lawyer in his or her home Member State. The conditions of the capacity to concludde contracts and that the person is trustworthy are proven by a certificate issued according to the regulations of the lawyer's home Member State. The lawyer is fully or partially exempt from payment of insurance if he or she is fully or partially insured with regard to the conditions and scope of insurance coverage in the home Member State.

The examination of knowledge of Slovenian legislation is conducted pursuant to the provisions of the act regulating the state legal examination.

Proof must be no older than three months and must be submitted in the form of a certified translation into Slovenian.

A lawyer from another country who is not registered in the register of foreign lawyers may provide the following services:

  • legal advice on the legislation of his or her home Member State;
  • legal advice on EU legislation;
  • legal advice on international law and Slovenian legislation.

A lawyer who is not registered in the register of foreign lawyers must notify the Slovenian Bar Association prior to the provision of services by submitting proof of the qualifications to practice the profession of lawyer and proof of professional liability insurance in the home Member State.

On this basis, the Slovenian Bar Association issues the lawyer a certificate on the notification of the provision of services. No appeal is possible against a negative decision of the Slovenian Bar Association.
