Strategic activities
Strategic activities are activities related to strategic goods. Strategic goods are strategic substances, strategic equipment and strategic technology.
The strategic activity is each:
- development,
- research,
- production,
- processing,
- destruction,
- consumption,
- use,
- trade,
- transit,
- or any other activity involving strategic goods.
Strategic activities can be undertaken in accordance with the requirements as stipulated by the Law on Control of Strategic Goods of Particular Significance to Safety/Security and Health for the following purposes:
- industrial, agricultural, pharmaceutical, medical, scientific research and other peaceful means,
- protection against means of mass destruction,
- military purposes,
- maintenance of public peace and order
The person liable shall be any legal person, including any scientific, educational or other public institutions or national authorities, or an individual sole trader who performs strategic activities.

Applicants who wish to pursue this activity must register the business activity, and have the appropriate legal status.

Prior to the commencement of the strategic activity, the person liable has to notify the competent authority of these strategic activities or shall obtain authorization to perform strategic activities.
The authorization must be obtained by the person liable for dealing with strategic goods from group 1 or group 2 of the Decree on setting the list of strategic goods and related control regimes.
In order to notify activities or for issuing an authorization, the following requirements have to be met:
- the conditions regarding the implementation of appropriate organizational and security measures,
- the authorized technology,
- a strategic goods advisor and
- the conditions regarding impunity.

For strategic goods listed in group 1 of the Decree on setting the list of strategic goods and related control regimes, it is necessary to obtain a permit to carry out a certain strategic activity.
A permit for the implementation of a strategic activity is issued for each completed strategic activity separately. In special cases, a general authorization may be issued for several types of strategic goods, several countries or a longer period of validity.
In the process of deciding on the issuing of a permit, a strategic risk assessment is made, which assesses the possible consequences and the impact of the planned implementation of the strategic activity on national or international security. The procedure for preparing a strategic risk assessment begins with the application of the person liable The competent authority shall then request the competent members of the Committee for strategic goods (from competent ministries and other authorities) for opinions, views and relevant information, which they shall provide in writing. The final strategic risk assessment shall be made by the competent authority as a written document containing the assessment and justification.
The administrative fee is assessed in accordance with the Administrative Fees Act (Official Gazette of the Republic of Slovenia, No. 106/10 - officially consolidated text):
Subject to heading No 1, an administrative fee of EUR 4.50 shall be paid for each application and each supplement to an application. The administrative fee for the application is paid to sub-account 01100-1000315637 reference 11 27154-7111002-07293, with a certificate of payment of the fee attached to the application.
In order to obtain a permit to carry out a strategic activity, on the basis of tariff no. 46, point 3, levy the following fees for:
- permit for strategic activity (over 10 kg) EUR 35.00 and
- permit for the implementation of a strategic activity (up to and including 10 kg) EUR 15.00.
The fee based on tariff no. 46, point 3 shall be assessed upon receipt of a complete application on the payment order. Do not pay the fee before submitting the application.

Certain strategic activities falling into groups 1, 3, 4 and 5 of the Decree on setting the list of strategic goods and related control regimes require prior notification to the competent authority.
The announcement shall be made no later than 90 days before the end of the calendar year for the next calendar year.
The application must include:
- Data on the person liable:
- the address of the legal or natural person who intends to produce, consume or process strategic goods,
- the address and exact location of the facility where the taxpayer intends to produce, consume or process strategic goods.
- Information of performed strategic activities:
- description of the strategic substance:
- for the chemical: name of the substance and CAS number,
- in the case of preparations: trade name and chemical content with CAS number,
- for micro-organisms and toxins: name,
- a group from the Decree on setting the list of strategic goods and related control regimes (group 1, 2, 3, 4 or 5),
- the quantity of strategic goods intended to be produced, consumed or processed in the following calendar year,
- description of the intended strategic activity (production, consumption or processing),
- other relevant information.

persons liable are obliged to submit a report on the performed strategic activities in the previous year to the competent authority within 60 days after the end of the calendar year.
The report must include:
- Data on the person liable:
- address of the legal or natural person who performed the strategic activity,
- address and exact location of the facility where the strategic activity was performed.
- Information on implemented strategic activities:
- strategic goods to which the description of implemented strategic activities refers:
- for the chemical: name of the substance and CAS number,
- in the case of a mixture: trade name and content of the chemical with CAS number,
- for micro-organisms and toxins: name,
- customs tariff code,
- description of the implemented strategic activity; in the case of import or export, also information on the importer or exporter and the border crossing point through which the import or export was made,
- quantity of strategic goods.
The report shall be submitted to the competent authority in electronic or written form.

A report on the amount of chemicals produced during the previous year must be submitted to the competent authority within 60 days after the end of the calendar year.
Reporting is mandatory for any legal person or individual sole trader that produces a discrete organic chemical that:
- is not included in the list of strategic goods, but belongs to the class of chemical compounds, composed of all carbon compounds, except oxides, sulphides and metal carbonates, and
- it can be identified by its chemical name, structural formula, if known, and CAS registry number, if given.

persons liable must have kept records containing documents on the implemented strategic activity. The records must show at least:
- the type of strategic goods, the name from the list of strategic goods and its trade name;
- the quantity of strategic goods produced or acquired;
- quantity of strategic goods issued or consumed with information on recipients (buyers);
- the quantity of strategic goods in stock or in use by the liable party.
The records must be kept for at least five years and submitted to the competent authority upon request.
