Concession for natural gas transmission
The Republic of Slovenia as the concession provider can provide a concession for the implementation of the public utility service of natural gas transmission operator for the entire territory of the Republic of Slovenia for a maximum period of 35 years.
The Government of the Republic of Slovenia issues a decision granting the concession for the implementation of the public utility service under this regulation to the concessionaire without a public tender. M
utual relations between the government and the concessionaire are specifically regulated in the concession contract.
The transmission system operator activity can be implemented by a concessionaire that fulfils the following conditions:
- owns a transmission system;
- a transmission system operator certificate and
- is appointed as the transmission system operator.

Transfer system operators must have human, technical, physical and financial resources required to fulfil their obligations and to pursue the activity of natural gas transfer.
Transfer system operators must own the entire transfer system and other resources required to pursue the activity of natural gas transfer. Transfer systems where transfer system operators pursue their activity must not be partially or fully owned by another party.

Transfer system operators must be certified.
The certification procedure commences when the owner or the operator of the transfer system files a complete application for the issue of the certificate.
When it receives a complete application for certification, the competent authority issues a certificate of receipt of a complete application which must include the deadline for the decision on the certification request and information on the conditions when the legal basis for the issue of the certificate is used.
The competent authority must decide in the matter within four months of the receipt of a complete application.

At the proposal of the Energy Agency, the Government appoints the operator of the transfer system with a decision.
A decision on the appointment is published in the Official Journal of the European Union and the Official Gazette of the Republic of Slovenia, and submitted to the European Union.
