Concession for the provision of work
The authorised organisation or employer cannot enter the provision of work in the court register or apply the initiation of the performance of this activity, if no concession contract has been concluded.
The organisation or employer who wants to provide work addresses the application for the granting of concession to the ministry competent for labour.
Such application shall contain:
- name and head office of the legal entity or sole entrepreneur, data on the management, representation and scope of authorisations;
- the field of activity for which the application is lodged;
- data on persons that will perform the concession activity;
- the list and description of technical equipment for the implementation of activities;
- the method of protecting personal data in accordance with the rules on the protection of personal data;
- indication whether any other activity is performed besides the intended activity;
- accurate address of the place of performance of the intended activity;
- envisaged financial sources for performing an activity.
In the case of activity of employment and work brokerage, the ministry can obtain the opinion of the Slovenian Employment Service on granting the concession, and in the case when work is provided for pupils and students they can obtain the opinion of the Slovenian Student Organisation.
When deciding about the application for granting the concession, the ministry competent for labour considers the number of unemployed at the branch office of the Slovenian Employment Service, employers' needs for work or employment of new workers in this area, the number of pupils and students in an individual field and their social position, the number of concessionaires in an individual area and respecting regulations at the operations of the applicant.
The ministry competent for labour decides on the application for granting the concession, i.e. with an administrative procedure decision.
The applicant can provide work when the concession contract is concluded.
The ministry competent for labour concludes a concession contract with the applicant who was granted the concession. The concession provider and the concessionaire regulate mutual concession relationship with the concession contract, especially:
- the type and scope of service subject to the concession;
- the start of implementation of concession;
- the time for which the concession contract is concluded;
- the amount of recognised costs and the amount of deducted funds;
- concessionaire's duty of reporting to the concession provider;
- contractual sanctions with regard to the non-implementation or inappropriate implementation of the concession;
- financial, expert and administrative control plan, performed by the concession provider;
- the method of altering the concession contract or concession relationship;
- the termination of validity of the concession contract and its potential extension;
- the obligations of the concessionaire at preliminary termination of contract validity;
- other provisions relevant for the determination and implementation of activities subject to the concession.

The Agency shall have administrative-technical personnel that may carry out auxiliary tasks and shall not independently pursue the activity.

The Agency shall have appropriate working premises and auxiliary premises and suitable office and technical equipment that provide the keeping of proper records and enables the competent authorities and authorised persons to have an insight in its operation.
The working premises are a separate room or area which provides the protection of personal data of users. The auxiliary area is an anteroom separated from the working premises which enables clients to wait. The Agency shall also have sanitary facilities for clients and employees.
The certificate on the granted concession shall be placed at the visible spot in the business premises.
The Agency shall provide the implementation of the activity of labour brokerage so it is also accessible to disabled persons.

For every year when the actual income from the concession activity for the previous year was established, the Agency pursuing the activity of labour brokerage to pupils and students shall accordingly form a risk fund in the amount of 0.8% of the income from the concession activity in the previous year for the events of non-payment of employers for the conducted works of pupils and students, and determine the way of using the means of the funds by forming the eligibility criteria, order of payments, deadlines and rules of recording business events related to claims in its general act.
The means of the risk fund may be used for the payment for work of pupils or students and related taxes. The Agency shall initiate the enforcement procedure against the debtor no later than on the day of payment for work from the risk fund.
The Agency notifies the ministry about the rules of operation of the fund and provides that this rules are publicly accessible to all interested parties.
The Agency exercises the claim against the debtor according to the general rules of the civil law for the means paid from the risk fund. The means of the risk fund are managed on the special account.
When the means of the risk fund are exploited for the current year, the further payments are executed in the next year when the new risk fund is formed.

The Agency shall envisage financial sources to pursue an activity.

The agency for labour brokerage or labour brokerage for pupils and students must employ a professional worker with at least high education and two years of appropriate work experience.
At every location of activity, the agency must employ at least one professional worker who fulfils the below stated conditions.

The organisation or employer with the signed concession agreement with the ministry responsible for labour shall report on the annual basis about the scope of its operation and about its work and constantly report all changes related to the fulfilment of personnel, organisation and other conditions that may affect the concession relationship.
The Agency pursuing the activity of labour brokerage shall submit the ministry the annual report on its operation no later than 31 March for the previous year.
The report shall include the following data:
- status of a job-seeker;
- realised employments of a job-seeker;
- realised employments of a job-seeker with the subsidy of the Employment Service of Slovenia;
- copy of the profit and loss statement;
- financial and other data on the employment or labour brokerage.
The Agency that provides work for pupils and students shall submit the annual report no later than 31 March for the previous year and in it list the following data:
- number of the issued referrals;
- number of realised referrals after the conducted work;
- copy of the profit and loss statement;
- income from the concession activity;
- realised costs for conducting concession activity;
- amount of deducted costs from the concession fees;
- total number of employees at the Agency and its branches;
- report in the payments from the risk fund.

Renewal term
Organisations or employers who have concluded the concession contracts with the ministry, lodge the application for the extension of the new concession at least two months prior to the expiry of the validity of the concession contract.
These applications are considered as applications received simultaneously. Other applications for the granting of the concession are considered according to the order as received at the ministry.
Renewal term: 1 year
