Licence for performing the activities of organising and selling package travel
A licence for the activity of organising and selling packages is a condition for the lawful pursuit of this activity on the market.
An application to obtain a licence must be lodged with the Tourism and Hospitality Chamber of Slovenia, where applications are considered by the Licensing Commission once a month.
The Tourism and Hospitality Chamber of Slovenia issues a decision on granting a licence to the applicant.

No licence is required if:
- package travel and linked travel arrangements cover a period of less than 24 hours and do not include overnight accommodation;
- package travel and linked travel arrangements are offered or performed occasionally (the total annual amount paid for their performance does not exceed EUR 15,000) on a non-profit basis to a limited groups of travellers only and are not publicly advertised;
- package travel and linked travel arrangements are purchased on the basis of a general agreement for the arrangement of business travel between a company and another natural or legal person who is acting for purposes relating to the company's gainful activity.
The organiser of the package travel and linked travel arrangement referred to in indents one and two is obliged to inform travellers in a clear and comprehensible manner before the start of the package that it does not guarantee the fulfilment of the conditions for the pursuit of the activities of a tour operator.
The organiser of the package travel and linked travel arrangement referred to in indent one is obliged to provide a tour leader or a tour guide.
Withdrawal of the licence:
- The licensee ceases to perform the activity of organising packages and selling packages;
- The licensee no longer meets the conditions laid down for a licensee.

For the purpose of organising package travel, it is compulsory to register the activity under 79.120: Tour operator activities, for selling package travel activity under 79.110: Travel agency activities, and it is also recommended to register the activity under 79.900: Other reservation service and related activities.

In order to pursue the activity, e service provider must have business premises.
In order to be granted a licence for the activity of organising package travel, the tour operator must have business premises.
In order to be granted a licence for the activity of selling packages, a travel agent must have business premises which are accessible to customers during the specified operating hours.
Evidence
- evidence of having business premises at its disposal (a Land Register extract, a purchase or lease agreement, a court decision or order, etc.) except in the case of online sales only* where the tour operator does not need business premises.
*For online sale only, a written statement stating that packages are offered for sale only through their website.

In order to obtain a licence for the activity of organising package travel, a tour operator is obliged to provide a guarantee regarding the operator’s liability in the event of insolvency in accordance with the act governing consumer protection.
The minimum level of the guarantee required (Articles 5 and 14 of the Decree) must cover at least 10% of the tour operator’s annual turnover. The only exception is inclusion in a guarantee scheme, which sets two per cent of the total annual turnover of all tour operators covered by the guarantee scheme as the minimum amount of the guarantee required.
A tour operator with no annual turnover in the preceding business year must provide the minimum level of guarantee required to ensure coverage of at least 10% of the planned turnover.

Attachments
- Extract from the Slovenian Business Register in which the director or legal representative is entered. The extract must show the registration of the activity in accordance with the Standard Classification of Activities.
- Statement of business premises and working hours
- Evidence of having business premises at its disposal (a Land Register extract, a purchase or lease agreement, a court decision or order, etc.) except in the case of online sales only* where the tour operator does not need business premises.
- Evidence of the provision of a liability guarantee in the event of insolvency in accordance with the Consumer Protection Act
- Copy of the payment order and proof of payment of the administrative fee

- Decision granting a licence and certificate for the sale of package travel: EUR 206.00
