Nature conservation conditions and nature conservation consent
For the construction of a structure within an area with special status under the regulations governing nature conservation, and for which no building permit is required, nature conservation consent must be obtained.
Nature conservation consent must be obtained in cases where the construction of a structure is to be carried out in an area with special status under the regulations governing nature conservation.
The areas having special status under the regulations governing nature conservation are as follows:
- Natura 2000 sites - special protection areas and potential special protection areas designated by the Decree on special protection areas;
- protected areas designated by legal acts on protection; and
- areas of natural values of national or local importance, designated by the Rules on the designation and protection of natural values.
If the works take place in an ecologically important area, no nature conservation consent is required under the Decree on ecologically important areas.
According to the Building Act, the construction of a structure in an area with special status under the regulations governing nature conservation, and for which a building permit must be obtained, requires the opinion of the Institute of the Republic of Slovenia for Nature Conservation and not nature conservation consent from the Ministry of Natural Resources and Spatial Planning. Similarly, no nature conservation consent is required under the Nature Conservation Act if the construction of the structure is subject to an environmental impact assessment procedure under the regulations governing environmental protection. In this case, environmental consent is issued instead of nature conservation consent.
