Permit for implementing professional tasks
The legal entity or sole entrepreneur must perform all professional tasks diligently and under professional rules. Documents issued at the implementation of professional tasks, must enable traceability and transparency.
A legal entity or sole entrepreneur who wishes to obtain the permit under the mentioned rules, makes an application at the ministry competent for labour for the issue of the permit. The application for the acquisition of the permit shall contain:
- the indication of professional tasks for which the permit is intended;
- evidence on ownership or long-term lease of technical equipment, records on technical equipment, certificates on calibration and evidence of maintaining electronic technical equipment and evidence of maintaining mechanical technical equipment under their ownership;
- contracts of employment of professional staff, evidence of acquired education, working experience;
- documented methodology for reviewing and testing working equipment or testing the work environment that fulfil the demands determined with harmonised standards and the profession in the field of safety and health at work.
The permit holder must notify the ministry competent for labour within 15 days of each change that can impact the performance of professional tasks for which the work permit was issued, especially changes in connection with technical equipment and professional staff.
The minister competent for labour issues renews and withdraws the permit with a decision in the administrative procedure based on viewing and opinion of a three-member commission.
If, in the procedure of permit issue or renewal, the minister does not issue or submit the decision within three months from the date when the application is complete, it is considered that the permit was issued or renewed.
The permit, renewal or withdrawal of the permit is entered in the record file managed by the ministry competent for labour and contains:
- registration number;
- name, address and identification number of the legal entity or sole entrepreneur;
- the number and date of decision on the acquisition, renewal or withdrawal of the permit;
- the scope of professional tasks;
- the date of permit entry in the register;
- the list of professional staff.
The permit holder can start performing professional tasks on the date of entry in the record file.
All costs must be settled when the application for the acquisition of the work permit is lodged. Until the tax is paid, the decision on the subject work permit cannot be delivered.
Conditions

A professional worker for safety at work pursues the professional tasks in the field of periodic inspections and tests of working equipment.
A legal person or individual sole trader may pursue professional tasks with such number of professional workers fulfilling the below stated conditions so that the professional tasks are carried out pursuant to the methodologies stated in the application.
A professional worker must have proper education, adequate work experience and passed the complete professional examination in the field of safety and health at work.

To conduct professional tasks, a legal entity or individual sole trader shall own or long-term lease the technical equipment which the professional worker must have proper knowledge of to handle with.
A long-term lease of technical equipment shall last at least as long as the permit to conduct that professional task, for which this technical equipment is used for.
Technical equipment, required to conduct periodical inspections of harmfulness in a working environment and periodical inspections and tests of working equipment is listed in this link.
The legal entity or individual sole trader pursuing the expert tasks of periodical inspections and tests of working equipment shall own or long-term lease the technical equipment referred to in Point B and methodology of implementation of periodical inspection and tests of working equipment. Technical equipment shall comply with the purpose of implementing periodical inspections and tests of working equipment.
When not used, the technical equipment shall be stored in the facilities specified in advance which are protected against harmful impacts of heat, dust, moisture, steam, smoke, vibrations or electromagnetic fields and radiations.
Mechanical technical equipment must be regularly maintained. In additional to regular maintenance, the electronic technical equipment shall be also calibrated. Evidence on calibration and maintenance works shall be kept by the owner of the equipment.
Every part of the equipment or device exposed to harmful impacts or misused or showing dubious measuring results or proven inappropriate during calibration or maintenance, shall be immediately disused.
The owner of the permit shall keep records for technical equipment which include the following data:
- number and date of record;
- name of technical equipment, identification of the type and serial number;
- name of manufacturer;
- date of take over and date of application of technical equipment;
- technical state at the take over;
- number and date of the issue of the certificate on performed calibration procedures for electronic technical equipment;
- calibration deadlines;
- dates and descriptions of performed maintenance works for electronic technical equipment;
- dates and descriptions of performed maintenance works for mechanical technical equipment;
- current location of equipment.
The attachments to the records are:- certificates on the performed calibration procedures for electronic technical equipment or statements on the conformity for new electronic technical equipment;
- evidence on the performed maintenance works for electronic technical equipment;
- evidence on the performed maintenance works for mechanical technical equipment;
- description of faults, malfunctions, changes or repairs.

The holder of the permit shall submit the ministry, responsible for labour, annual reports on the tasks being performed within the end of February for the previous year.
The annual report may be filled out and sent via an electronic form available with the user name and password. The instructions for use of information system are also available.
The forms may also be filled out, printed and sent to the ministry responsible for labour.
This report must contain:
- general data on the legal entity or natural entity;
- data on the implementation of professional tasks;
- proposals and comments regarding the implementation of professional tasks in the field of safety and health at work (this part of the report in optional).

A professional worker of periodic inspections pursues professional tasks in the field of conducing periodic inspections of harmfulness of the working environment. A legal person or individual sole trader may pursue professional tasks with such number of professional workers fulfilling the below stated conditions so that the professional tasks are carried out pursuant to the methodologies stated in the application.
A professional worker must be qualified to conduct professional tasks of safety at work and must constantly participate in education and training programmes as per the internal acts of the employer. The qualification to conduct professional tasks is evaluated in terms of the type of activity being pursued by the employer and according to the types and levels of risks of injuries at work, occupational diseases related to work and in terms of the number of employees.
A professional worker must have proper education, at least three years of adequate work experience and pass the whole professional examination in the field of safety and health at work.

The legal person or individual sole trader performing periodical inspections of the harmfulness of the working environment, must own or long-term lease the technical equipment referred to in Point A, according to the types of periodical inspections he performs and methodology of implantation of periodical inspections of harmfulness of working environment.
Technical equipment shall fulfil the requirements of valid technical standards and provide the implementation of measurements in at least such measuring environments that include values determined with regulations in the field of safety and health at work.
The legal person or sole trader performing periodical inspections of hazardous chemical substances in the air of the working environment must provide that the analysis of hazardous chemical substance in the air of working environment is carried out by the body accredited for the methods that enable analysis of sampled hazardous chemical substances.

Renewal term
The evidence of the professional worker on their permanent professional qualification must show acquired 100 credit points, when the professional worker is constantly employed at the permit holder for at least seven years. Out of these 100 credit points, at least 30% of the points must be acquired at training sessions in the fields of those professional tasks that are implemented and for which the permit holder obtained a permit.
A professional worker who is employed at the permit holder for less than seven years must have a proportional number of acquired credit points with regard to the full years of employment.
The permit holder who wants to renew the permit lodges an application at the ministry competent for labour for the issue of the permit at least three months prior to the expiry of the permit.
The application for the acquisition of the permit shall contain:
- the indication of professional tasks for which the permit shall be renewed;
- evidence on ownership or long-term lease of technical equipment, records on technical equipment, certificates on calibration and evidence of maintaining electronic technical equipment and evidence of maintaining technical equipment under their ownership;
- contracts of employment of professional staff, evidence of acquired education; working experience and passed professional examination;
- documented methodology for reviewing and testing working equipment or testing the work environment that fulfils the demands determined with harmonised standards and the profession in the field of safety and health at work.
Besides this, the application for renewal or re-acquisition of the permit must contain the evidence on permanent professional training of professional workers.
