Permit for trade in firearms

A legal entity or an entrepreneur can start trade in firearms after obtaining a relevant permit from the Ministry of the Interior.

If the trader changes its activity, it must obtain a new permit, while in the event that it ceases its activity, it must hand over the issued permits and records it is required to keep to the competent authority within eight days.

  • The responsible person of the trader and the individuals employed by it who perform direct work in connection with trade in and transport of firearms and ammunition must, in addition to the general conditions set by the regulations governing employment relationships, be citizens of the Republic of Slovenia.

  • The competent authority issues an individual a permit to purchase a firearm, a permit to purchase ammunition, a firearm licence and a permit to possess a firearm if they are at least 18 years of age.

  • The responsible person of the trader and the individuals employed by it who perform direct work in connection with trade in and transport of firearms and ammunition must, in addition to the general conditions set by the regulations governing employment relationships, also meet the following conditions:.

    • no public order concerns,
    • be responsible.

    Public order concerns exist if the individual is convicted by a final judgement of committing a premeditated criminal act involving violence that is prosecuted ex officio, or for committing a criminal act of trafficking in human beings or unlawful manufacture and trade in narcotic drugs, illicit substances in sport and precursors to manufacture narcotic drugs.

    If criminal proceedings are being conducted against the individual, the procedure to examine whether this condition is fulfilled is suspended until the final decision in the criminal proceedings.

    An individual is responsible if it can be concluded based on the established facts that they will not misuse weapons or use and store them carelessly, unprofessionally and negligently, or leave them in the possession of a person who does not have a valid firearm licence, a permit to possess firearms, a permit to collect firearms, authorisation to carry firearms or authorisation to transfer firearms, or in the possession of a minor, unless otherwise provided by law.

    An individual is by no means responsible if:

    • they are convicted by a final judgement of committing a premeditated criminal act or are fined for a minor offence against public order and peace involving elements of violence, and are for this reason unfit to possess or handle a firearm, or can be expected to misuse firearms,
    • they have been placed under guardianship by a court decision and have been appointed a guardian due to an intellectual disability or mental health issues or other reason and are for this reason unfit to possess or handle firearms or can be expected to misuse firearms,
    • they are addicted to alcohol or drugs,
    • the circumstances in which they live show that they are not fit to possess firearms.

  • Knowledge of handling firearms is proven by a certificate of a passed test. The minister in charge of internal affairs determines the training providers. The training programme on handling firearms and the method and procedure of a test of firearms handling knowledge are determined by the Rules on training and firearms handling examinations.

    The costs of the test are paid by the individual.

    It is considered that an individual has passed a test of firearms handling knowledge if they have passed a test in accordance with the regulations governing the carrying of firearms in state bodies, if they are a hunting trainee who is a member of a hunting club and submits a certificate of a passed test of firearms handling knowledge in accordance with the regulations governing hunting, if they have passed the hunting test or if they are a security guard who has passed a test of firearms handling knowledge in accordance with the regulations governing private security and on the mandatory organisation of a security service.

    Legal basis

  • The individual undergoes a medical examination at a health institution or with a private physician who is authorised to issue a certificate on the fulfilment of the medical conditions for possessing or carrying a firearm. The medical institution or the private physician send the medical certificate to the administrative unit and the personal physician.

    An individual who disagrees with the medical certificate may request to be re-examined before a special medical commission. The opinion of this commission is final.

    The medical certificate is valid for one year. The costs of the medical examination are paid by the individual.

    The medical conditions that an individual must meet in order to possess or carry a firearm are determined by the Rules concerning medical examinations establishing the health requirements of an individual carrying or possessing firearms.

  • Premises intended for trade in firearms must be mechanically and electronically protected so that access by unauthorised persons is prevented.

    If category A firearms or more than 30 pieces of firearms of categories B and C are stored in the premises, the signal of the electronic detectors must be connected to the intervention centre of the security company when the facility is not in operation and there are no people in it If manufactured, modified and repaired firearms are stored in a safe or fireproof cabinet, they can also be stored in the area for the production, modification or repair of firearms, while in other cases they must be kept in a room that is separated from the area for the production, modification and repair of firearms.

    Firearms must be stored separately from ammunition in a burglar-proof container, and ammunition in a fireproof cabinet.

    In premises intended for the sale of firearms, firearms can be displayed in display cases or by being secured by a mechanical lock.

    If firearms are displayed in a shop window, it must be mechanically protected with safety glazing against intrusion and with electronic protection against breakage. If the metal gratings are equipped with a sensor cable, safety glazing is not required.

    In the event that trade is conducted only with firearms from points 2 to 4 and 6 to 9 of category D, the premises must be mechanically protected. Such firearms may be displayed as specified in the third paragraph of this article. If firearms are displayed in a shop window, it must be mechanically protected.
