Patent representative

Patent representatives represent the parties to proceedings relating to the acquisition, maintenance and other requirements in connection with any right under the provisions of the Industrial Property Act (ZIL-1). In proceedings relating to the rights under ZIL-1, patent representatives may also represent parties before courts and other state authorities if they meet the requirements laid down by the regulations governing representation before the courts and other state authorities. The authorising person may authorise one or more representatives for all or some of the acts in proceedings before the Slovenian Intellectual Property Office (hereinafter: the Office).

Prior to the commencement of the representation activity, patent representatives must pass the examination for patent representative before the Office and register in the Register of Patent Representatives kept by the Office.

Conditions

  • Slovenian Intellectual Property Office (hereinafter: the Office) keeps the Register of Patent Representatives. Application for registration in the Register of Patent Representatives must include:

    • Proof of the applicant’s data (surname, name, address and education): if the applicant is a sole trader or a legal person, an extract from the Slovenian Business Register or from the court register (both are kept by the Agency of the Republic of Slovenia for Public Legal Records and Related Services (AJPES)) shall be obtained ex officio by the Office in accordance with the third paragraph of Article 66 of the General Administrative Procedure Act (ZUP). If the applicant is a natural person, the Office shall also obtain this personal data on the basis of the third paragraph of Article 66 ZUP from the official records; however, if the applicant declares that he/she prohibits the Office from obtaining these personal data from the official records or that he/she wishes to obtain these data by himself/herself, the applicant must provide appropriate supporting documents showing his/her details;
    • The attached proof of compliance with the requirements referred to in the second paragraph of Article 131 ZIL-1 (university degree in a technical or scientific field and certificate of the patent examination passed before the Office);
    • Proof of payment of the fee;
    • Proof of employment of the person meeting the requirements for a patent representative who has a university degree in a technical or scientific field and has passed the patent representative examination before the Office (legal persons only);
    • Proof of employment or a contractual relationship with the person meeting the requirements for a patent representative who has a university degree in a technical or scientific field and has passed the patent representative examination before the Office (attorneys and law firms only);
    • A list of natural persons meeting the requirements for a patent representative (who have a university degree in a technical or scientific field and have passed the patent representative examination) (legal persons only).

    The following data are entered in the Register of Patent Representatives:

    • Type of representative: patent representative;
    • Registration number;
    • Date of registration;
    • In the case of a natural person: surname, name, address and education;
    • In the case of a legal person: registered name, registered office and list of natural persons meeting the requirements for a patent representative (who have a university degree in technical or natural sciences and have passed a patent representative examination before the Office, including their data: surname, name and education).
