Permit for retail sale of pyrotechnic products

A legal entity or an entrepreneur can start retail sale of pyrotechnic products after obtaining a permit from the competent administrative unit in the area in ​​which the activity will be carried out.

If the permit holder changes its activity, the premises where it performs its activity or its legal status, it must obtain a new permit.

The permit holder must notify the competent administrative unit in writing within eight days of any change in legal status, change of the responsible person or cessation of the performance of the activity.

Permit may be revoked if the legal entity or entrepreneur:

  • no longer meets the conditions prescribed by law;
  • ceases to perform the activity.

Within eight days after the decision on permit revocation becomes final, the legal entity or entrepreneur must hand over to the competent administrative unit all the records that is required to keep.

  • In order to perform the activity, you are obliged to register and select the appropriate status form.

  • A responsible person for work in a shop with pyrotechnic products is a person with suitable professional training. Individuals who perform individual work with explosives or pyrotechnic products for a legal entity or entrepreneur must meet the following conditions:

    • at least 18 years of age
    • no public order concerns and
    • professional competence

  • Facilities for the production, sale and storage of pyrotechnic products must be built and equipped in such a way that fire protection, protection of life and health of people and of property, and environmental protection are ensured. Production, sale and storage facilities must be secured against access by unauthorised persons.

    A point of sale or a shop with gunpowder or pyrotechnic products can have a floor area of no more than 80 m2. This condition does not apply to specialised shops. The fire resistance of the building must be at least REI 30. At least 40% of the floor plan area of ​​the shop must be intended for aisles. No aisle intended for employees may be narrower than 75 cm. No aisle intended for customers may be narrower than 90 cm.

    The alarm system in the event of danger must ensure the safe withdrawal of customers and employees, which must be organised in such a way that the route for withdrawal to another fire cell, a shopping route in the shopping centre or outdoors is no longer than 15 m.

    If the entrance door to the shop is also used as an evacuation door, it can also be a sliding, lifting or revolving door. Such a door must be additionally connected to a backup power source and enable operation at any time, i.e. to an automatic fire alarm that ensures that in the event that an alarm is triggered, it is open and the evacuation route is clear.

    There must be no source of ignition or chimney openings in the storage facility, and it must be heated only with hot water. The temperature of the free surface of heating elements and pipelines in the premises must not exceed 75ºC under any circumstances. Heating elements must be installed or secured in such a way that objects cannot be placed on them or in their vicinity. There must be no electrical devices in the premises, except for lamps, which must comply with applicable electrical engineering regulations. Distributors, circuit breaker or fuses must not be used in the premises. Lighting and heating switches must be located outside the premises. At least two fire extinguishers must be within reach in the immediate vicinity of the warehouse entrance. For smooth handling, aisles in the storage facility must be at least 75 cm wide. The storage width and the width of the shelves must not exceed 80 cm. The maximum permitted storage height is 220 cm. The height of the free space up to the ceiling must not be less than 60 cm. The distance between the shelves and the walls must be at least 5 cm. The shelves must be secured so that they cannot tip over. Unauthorised and uninvited persons must be prevented from entering storage facilities. A storage facility that is located within a shop must be separated from the point of sale with a door with fire resistance of at least REI 30 and a self-closing mechanism. The door must open in the direction of evacuation. Such a storage facility must have adequate openings to release overpressure. The openings must be such that water, rain, animals, etc. cannot enter the facility. A commercial storage as an independent facility must be inaccessible from all sides to unauthorised or uninvited persons, for example, it must be surrounded by a fence at least two metres high. There must be a three-metre free space around the storage facility. Parking, except during loading or unloading, is not permitted within a distance of 6 m around the storage facility. No flammable substances or pressurised containers, except for fire extinguishers, can be placed at a distance of less than 20 m from the storage facility.

    There can be no more than two immobile warehouses in one facility and there can be no more than one mobile container made for the storage of explosives or pyrotechnic products in one open space. If the two warehouses touch each other, there must be a fire wall with fire resistance of REI 90 between them. Doors with a fire resistance rating of at least REI 60 must be at least 6 m apart from each other. The following signs must be placed on the door to the commercial storage facility and on the door in the fence around the facility as a stand-alone building (storage facility for gunpowder and pyrotechnic products; maximum NEM in the permit for the use of storage facility; no smoking sign; no open fire sign; sign for no entry for unauthorised persons). Letters and numbers in texts must be at least 6 cm high, the background must be contrasting, and prohibition signs must be at least 20 cm in diameter. When there are no employees in the storage facility, it must be locked, and the keys held only by the responsible person. Outside of the work hours, it must be mechanically or electronically protected.

    In the event that the activity is carried out in a container, a permit for the installation of a temporary container is issued for the duration of the lease contract, but not longer than 5 years. A container for the sale or storage of pyrotechnic products must meet the following requirements:

    • the investor has a valid contract with the owner or manager of the land (right) on the temporary placement of the container on the land on which it intends to place it;
    • the placement of the container is not in violation of the spatial acts;
    • the container is placed on the land belonging to the building (ownership or lease) for commercial or another service activity, or is an integral part of it (parking lot, square, etc.), but may not be placed on accessible, driveway or work surfaces for emergency vehicles.

    The container must be made of non-combustible materials. The parts of the container that are made of sandwich panels with a double-sided metal coating must have a classification of fire reaction of A2-s1, d0 in accordance with the applicable SIST EN standards. The floor area of the container must not exceed 30 m2, and the maximum internal height is limited to a maximum of 3 m, measured from the lowest point of the container floor. The container must be grounded and equipped with electronic protection, a fire detection and reporting system, and an alarm system. The container can be designed to allow the sale in the container or through an opening in the wall. If sale is performed in the container, at least 20% of the container space must be allocated to customers, and access to pyrotechnic products must be prevented. The door of the container must be equipped with a panic bar, and it must open outwards. A container that enables the sale through an opening in the wall must be equipped with an overhang and a platform that allow customers to safely purchase pyrotechnic products. When the sale is not performed, the opening must be closed from the inside and outside with an impact-resistant plate and locked from both sides with at least two locks. The container must be placed at least 10 m from the entrance to the building for a commercial or other service activity. The distance from the walls of the building must be determined on the basis of the fire safety assessment made by the responsible fire safety designer, although it must not be smaller than the vacated space as specified in the third paragraph of this article. If several containers are placed in front of an individual building, they must be at least 10 m apart. One container intended for the storage of pyrotechnic products can also be placed in the immediate vicinity of the container for the sale. The wall and door between two containers must be non-combustible and its fire resistance level must be at least (R)EI 60. If the containers do not touch, they can be no more than 2 m apart. There must be a three-metre empty space around the container, where parking is prohibited, except during loading and unloading of items intended for sale in the container.

  • A legal entity or entrepreneur who applies for a permit for wholesale trade in pyrotechnic products

    must attach to the application a safety statement with a risk assessment, as determined by the regulations on occupational safety.

  • It is required to attach to the application for the issuance of a permit for retail sale of pyrotechnic products an action plan in the event of an accident or other extraordinary event (explosion, fire, burglary...), which is made and adopted by the legal entity or entrepreneur who wants to engage in retail sale of pyrotechnic products.
